Terms and refunds
Hierax. These terms are between you and the operator of Hierax (“we”). Paying, or continuing to use the app, means you agree to them. All sales are final.
The product
Hierax is a browser training timer. You install it by adding it to your Home Screen. It is not an App Store app. It is a timer and a log. It is not a firearm, not a safety device, and not a substitute for safe gun handling.
The app unlock is a one-time purchase of $29.99. Paid target sheets, when a price is shown, are separate one-time purchases. There is no subscription.
Who may use it
You must be 18, or the age of majority where you live, whichever is older. You are responsible for every person who uses the app on your phone or your account.
Purchase and delivery
Access is delivered when payment succeeds. Delivery is immediate. The account is for access and payment. Your strings stay on the device. If you create a connector key, a copy of those strings is kept for that account so your bot can read them and send a skill read back. Revoke the key and that copy is deleted.
Add the app to your Home Screen and open it from that icon. A browser tab is not the installed app. Closing the tab, clearing the browser, or switching phones does not move your strings. It also does not undo the sale.
Refunds
All sales are final. We do not give refunds.
We do not refund because you changed your mind, did not open the app, did not add it to your Home Screen, deleted it, cleared the browser, switched phones, lost a string, or disagreed with a time, a score, a group, or a zero.
By paying, you ask us to supply the digital access immediately. To the extent the law lets you waive a cooling-off or withdrawal right for digital content supplied right away, you waive it.
A chargeback or a reversed payment ends access. If a statute where you live gives you a refund right that a contract cannot waive, that statute controls this section. We do not offer refunds beyond that.
Safety
Times, scores, groups, and zeroing cues are aids. They can be wrong. You alone verify that a firearm is unloaded, follow the rules of your range, and own every shot you fire. Dry fire and laser work require an unloaded firearm. Do not point a firearm at a screen, a person, or anything you are not willing to destroy. Live fire only where it is allowed.
Not match software
Hit factor and time-plus numbers are practice scores. They are not official USPSA, IPSC, or IDPA results, and they are not a classification.
Accounts
Keep your sign-in to yourself. You are responsible for purchases and use on your account. We may refuse, end, or restore access if a payment fails, is reversed, or breaks these terms.
No warranty
The app is provided as-is and as-available. We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the extent the law allows. We do not warrant that a time, a detection, or a zero is correct, or that the app will be uninterrupted.
Limit of liability
To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any injury, death, or property damage arising out of a firearm, ammunition, a laser, or a drill. Our total liability for a claim about the app or a purchase is the amount you paid us for that purchase.
Nothing in these terms limits liability that the law does not allow us to limit.
Indemnity
You will indemnify and hold harmless Hierax, its operator, and its contributors from any claim, injury, property damage, or loss arising out of your use of the app, a firearm, ammunition, a laser, or a drill, including dry fire, laser training, and live fire, or out of your breaking these terms.
Law
California law governs these terms, excluding its conflict-of-law rules. Courts in California are the venue, except where the law where you live does not allow that.
We may update these terms by posting a new version. The effective date at the top will change. Continued use after that date means you accept the update. The refund rule for a purchase is the rule in effect when you paid.
Contact
Questions about a purchase go to the email on your receipt. That is the contact for these terms. A question is not a refund request, and sending one does not create a refund.
